Web24 Apr 2024 · Amendments have been made to the Mental Health Act 1983 as a result of the Coronavirus Act 2024. These amendments increase the amount of time patients can be detained, remove the need for a second professional opinion to authorise certain decisions, and allow mental health tribunal hearings to be heard by telephone. WebSection 5(4) (nurse's holding power) of the Mental Health Act 1983 permits nurses of the 'prescribed class' to detain an informal inpatient. The patient must already be receiving treatment for mental disorder. The section lasts for up to 6 h. Section 5(4) is over 30 years old; however, there is relatively little literature exploring its use.
